Confusion Between Polynesian Village Pool Construction Contractors Leads to Suit Filing

Last year’s remodeling of the Polynesian Village Resort pool at Walt Disney World has apparently led to some confusion regarding subcontractors and payments. According to The Orlando Sentinel, Balfour Beatty — the general contractor on the project — has asked a judge to determine how who should get the $102,590 they’ve had set aside.

Balfour Beatty subcontracted Lake Mechanical Contractors, which in turn hired more subcontractors for the job. Some of those subcontractors say they did not get all of the payment they were entitled to.

In its court filing, Balfour states that one of Lake Mechanical’s lenders, New York-based New Era, has demanded that Balfour satisfy a judgment it holds against Lake Mechanical. The New Era judgment is due to a completely separate holdup on another construction job, a medical center in Lake City, according to court filings.

Balfour claims it is at risk of exposing itself to liability if it attempts to distribute the funds, and is asking the court to block any attempts to sue over the money and to determine who gets the money.

The pool in question is the Lava Pool, which reopened in the Polynesian Village Resort in May 2015.
